SB1070 Revisited: One Year Later
The challenge goes on...
Memorial Day weekend last year was marked by the anti-SB1070 law protest against the law passed by the Arizona State Legislature and signed by Governor Jan Brewer that took a strong stance against illegal immigration from Mexico. What has happened since then?
According to a study by BBVA Bancomer Research published in November 2010 there are 300,000 less Hispanics in Arizona since the law went into effect. Also the amount of money transferred from Arizona to Mexico is substantially reduced. Since then it is very likely many more have left and the flow of money out has also depreciated. Anecdotally in the central Phoenix area where I live there are far fewer people of Mexican descent evident than a year ago and relationships are changed. It is difficult to quantify how communication is different but interactions between Whites, Blacks (who are allied on this issue) and Hispanics are modified now, not necessarily hostile or suspicious but definitely cautious. This is in everyday interactions ranging from personal to work to public places.
From a legal perspective US District Court Judge Susan Bolton issued an injunction the day before the law was to go into effect stopping major parts of the law. An appeal to the notoriously liberal 9th Circuit Court of Appeals was refused stating that the federal government is likely to be able to establish the law is unconstitutional. In the interim between the two decisions, Obama's US Justice Department sued Arizona to block the law, stomping over the state's rights. This was predictable considering the Statist condition of the United States which is totally against the principles and ideals of America. [See: "This Is Not America | It is now merely the United States..."] Governor Jan Brewer is challenging the 9th Circuit Appeals Court ruling directly to the US Supreme Court, a considerably more conservative body.
Everything has changed but nothing has changed.
On a more practical and realistic level the fact remains that Arizona still has the most porous border of all of the Border States. Although the law caused illegal immigrants from Mexico to become less evident they are still ever present. In actuality the money is now flowing northward in the form of people and drug smuggling and the southern counties have more of a problem than ever. While the counties of Pima and Yuma conveniently choose to ignore the problem, the county directly north of them, Pinal, does not since the situation is now even worse for them.
A recent non-scientific poll by the Arizona Capitol Times asking the question "Should Gov. Jan Brewer use her new authority to call up a volunteer state militia [granted by the State Legislature] to bolster the efforts to stop illegal border crossings" had three choices of answers. The majority response was "Yes. The sooner the better." This is indicative of the overwhelming sense among most White and Black Arizonans that the federal government has done nothing, as promised, to help solve our border problem.
While what I have written may seem that I support SB1070 in totality, let me clarify my position at this juncture. My thought is there is at least one part of the law I specifically do not like and it is the "show me your papers" provision, which smacks right up against the American tradition of our ability to move about freely, which is a constitutional right. There are other provisions I find questionable also. The spirit and intent of the law, to force the federal governments hand out of the states right to defend itself from intrusion, does appeal to my sense of rejecting the unconstitutional encroachment of the federal government. If you question that, study the history of the US since 1913 and the Sixteenth Amendment to discover what is meant by that statement.
Federal Government now is Unconstitutional Centralized Government.
I am satisfied that the entire set of "Birther" laws was quashed by the sensibilities of the new State Legislature, rightly slapping the hand of State Senate President Russell Pierce (author of SB1070) and State Senator Ron Gould. The message of the voters and other legislators to them and their ilk was clear. "It's the economy stupid!" The state had achieved what it needed to do and that was challenge the federal government, particularly this administration, on their overreaching into a centralized government which has been entrenching itself in this country for decades. It is now working it's way through the system via our rule of law. This continues in another form, the Medical Marijuana Act passed by Arizona voters. Now the Obama Administration and Justice Department are threatening to sue state employees who engage in issuing licenses and pursue individuals for lawfully conducting business in what citizens clearly stated they wanted through a legal election process.
What this all really boils down to is that Arizona is an active microcosm of sentiment that is present all across this country. We represent the macrocosm attitudes and views that are growing across this nation that the government and major political parties are out of control. While SB1070 has not yet accomplished solving our illegal border crossing issue, it has set the stage for a showdown against the US Federal Government and the embedded Political Class that reinforces it. The challenge is far from over.

Pre-packaged agendas are for sissies, of both genders and all races. Buying into a Feminist, Gay, Liberal, Right Wing, Union, Religion, Tea Party, Political Party,Name-Your-Program, is a sign of not having an original thought. Few people fit neatly into boxes and categories.
In this video Willie Nelson (with an appearance by Burt Reynolds) gives stereotypes and as an aside, pre-packaged agendas, a run for the money. Regrettably a lot of people miss the point.

For What It's Worth
Red State, Brown People, Blue State Ideas...
"There's something happening here, what it is ain't exactly clear."
Arizona is on the leading edge of a national discussion on illegal immigration due to it's passage of legislation known as SB1070 or the Arizona Immigration Law. The original law was amended within a week after passage to specifically prohibit racial profiling and stipulate that the request to "show your papers" may only made in the course of enforcing any other law and not solely for the purpose of checking immigration status. This amendment is rarely cited when any mention of the law is made by the media or anyone speaking out against it.
The next step in the State of Arizona's process of attempting to stem the flow of illegal immigration through the porous border on the south, is to introduce into the legislature next year, proposals to deny birth certificates to children born in the state, of parents who are illegal immigrants. This idea is based on interpretation of the original US Constitution, various interpretations of the Fourteenth Amendment of the Constitution and the intention of Congress, as well as court rulings. It remains to be seen how that will play out between now and the next Arizona Legislative Session.
Another piece of legislation afoot is to charge students of illegal immigrants tuition for attending public schools. Therein lies another legal conundrum due to the US Supreme Court decision in Plyler v. Doe (457 U.S. 202, 1982) which ruled against a State of Texas statute withholding funds to school districts that allowed the children of illegal immigrants to attend their schools. Over the years this ruling has been cause for much debate regarding the overreaching of the Supreme Court in interpreting the Fourteenth Amendment.
Regardless of what view anyone holds on any of these issues and what opinion someone may have of the motivations of the legislator instrumental in spearheading these pieces of legislation or supporters of them, one thing remains plain, simple and clear. You don't need to go very far back in history to see it either.
All of this is leading up to a confrontation between the State of Arizona (and probably other states who are following suit) and the Federal Government. The last confrontation of significance between states over States Rights and the Federal Government was over school desegregation by primarily Southern States and occurred over decades from the 1940s to the 1970s.
There are other factors involved this time around. We are likely beginning to fully enter an economic depression of a magnitude not seen since the 1930s. Additionally, after thirty years of Affirmative Action there is a resentment, rightly or wrongly, that is seething under the surface. In unfortunate concert we have the first black President of the United States, who seems to operate on the level of a Middle Manager at an ineffective Non-governmental organization (NGO), with his priorities out of order. We also have a Political Class in legislatures and executive branches and Bureaucratic Civil Servants, on all levels of government, who clearly are so entrenched they do not see the people they were originally intended to serve. And then there's that Oil Spill...
The General Population is not happy generally. Make of that what you will. Let me be clear, I am only stating what I observe after careful watching, doing my best to keep an open mind and giving every opportunity to all sides to prove me wrong.
I can only see one result from everything that is building to a crescendo:

This video was taken on the Friday of Memorial Day weekend at Alto Arizona, an anti-SB1070 protest. The following day a pro-SB1070 rally was held. I view both events as the last opportunity I will spend time on for several reasons. Mainly I'm not sure what good comes from my attending any of them and I have a sneaking suspicion that any subsequent demonstrations will rival the civil disturbances and riots of the 1960s and 1970s and I experienced some of those.

Arizona Governor Jan Brewer does it again...
This time with puppets. Her new campaign ad is "Arizona-Sing-Along: Read Immigration Law!" and is catching on. The ad is quite clever and if nothing else, Jan Brewer is taking advantage of riding the crest of a wave. She's gained popularity since signing SB1070 and her goal of increasing the sales tax was passed by Arizona voters last Tuesday, May 18.
Her popularity may be short-lived when the backlash hits over her pushing the sales tax increase, which slapped hard the unemployed, low income and fixed income citizens (there are many in this state) in the face. The campaign to back the law was not supported by Republicans (she is running in the August 24th Republican primary to become elected Governor) but rather by their natural opponents. The primary force was public sector and teachers unions, their sympathizers and the Democrat Attorney General, also running for Governor in the Democratic Party primary.
When people realize it was false advertising by the proponents because Arizona public schools, beneficiaries of the sales tax, are notorious for bloated bureaucratic administration staffs and that the sales tax doesn't actually put teachers in the classroom...the joke will be on her.

The President of the United States is the head of the Executive Branch of the Federal government and holds the interests of all 50 states and represents them all. He should respect each state equally if he in turn expects the states and it's citizens to respect him. President Obama showed his true colors on May 1st when he made a tasteless joke about Arizona at the White House Correspondents' Association Annual Dinner:
"...And we all know what happens when you visit Arizona without ID, ADIOS, AMIGOS!"
Whatever you think of Arizona's Immigration Enforcement Bill (SB1070), no matter your party affiliation or political leaning, everyone should be appalled that a President would make a joke at the expense of a state on a subject that is at best, touchy. The correspondents all laughed but they would, they cover the President and are integral to the Beltway culture...actually they're not far from being members of the Political Class themselves, in spite of proclaiming to being "journalists."
My upbringing taught me that no matter who the President was, whether you had voted for him or not, he was to be respected because of the office he held. How does he think children and young leaders in Arizona will learn that respect if he doesn't respect the state they live in and have no control over what adults do?
This has given Governor Jan Brewer ammunition for her campaign for governor and she has seized the opportunity. This is the political ad she has running on media outlets and the internet.

Political Junkie Yard Dogs
Curs of Arizona: Politicians...
Dogs always bark louder behind a chain link fence.
The Political Class in Arizona has not served the citizens of the state well in recent years and there are several stand outs at not serving citizens but rather doing great disservice. The election in 2008, due to a combination of term limits, "Clean Elections" along with voters desire for change (they got it) created a bad brew, with the hangover of a Governor who inherited the job and not elected to the position.
The result was during an economic crisis of epic proportions, that created the worst state budget crisis in the US, our Governor and state Legislature did not even come close to rising above but instead lived down to the lowest expectations. Compounded with a US Congressional Delegation that displayed nothing less than contempt for the voters that elected them, a bad storm started brewing. It began with the budget crisis, extending on to Health Care Reform and Town Hall debacles, a disastrous Presidential run by one of our Senators ending ignominiously with the electioneering season and a contentious piece de resistance legislation.
The 49th Arizona State Legislature in the second sesssion decided to cap everything off by passing SB1070 to address a critical, long-standing problem in the state, illegal immigration and border crossing, a reactionary law signed by the Governor who wants to be elected. The Arizona Immigration Bill does little to realistically address the complicated issue and has done a lot of damage to the State and will for a long time. The intent of the bill, to stop criminal activity coming through the gaping hole Arizona border (that the federal government has left the state to it's own devices) contains US Constitutional and liberty dilemmas. It is the States' Right to address the situation but it shouldn't have been done creating a can of worms to be dealt with.
These characters proved to be the epitome of bad, the meaning of "bad" in it's original context of awful and not in anyway cool.
1. Arizona State Senator Russell K. Pierce (Republican, District 18): The Mesa legislator sponsored SB1070 and managed to get it passed by appealing to the basest of people's fear. 'nuff said.
2. Mayor Phil Gordon: (Democrat, Mayor of Phoenix): Obliviously didn't deal with the cities budget catastrophe, then called for a sales tax increase and has now paraded with opportunist Al Sharpton protesting SB1070.
3. US Senator John McCain (Republican, US Senator): Well...let's just say McCain has never met a side of any issue that he couldn't like depending on who he is talking to. He flip flopped so quickly on SB1070 it was awesome (also in the original and not cool context). Then there's that 2008 Presidential campaign...
4. US Representative Raul Grijalva: (Democrat, 7th District): Advocates "punishing Arizona," the very state that elected him and he supposedly represents, by calling for a national boycott. The insanity of an elected official calling for economic damage, cutting your nose off to spite your face, is absurd.
5. US Representative Ann Kirkpatrick (Democrat, 1st District): Walked out of her own Town Hall meetings on Health Care Reform because she was being asked questions by her constituency, who largely was (and is) against it. She has remained silent on SB1070.

2. Mayor Phil Gordon: (Democrat, Mayor of Phoenix): Obliviously didn't deal with the cities budget catastrophe, then called for a sales tax increase and has now paraded with opportunist Al Sharpton protesting SB1070.
3. US Senator John McCain (Republican, US Senator): Well...let's just say McCain has never met a side of any issue that he couldn't like depending on who he is talking to. He flip flopped so quickly on SB1070 it was awesome (also in the original and not cool context). Then there's that 2008 Presidential campaign...
4. US Representative Raul Grijalva: (Democrat, 7th District): Advocates "punishing Arizona," the very state that elected him and he supposedly represents, by calling for a national boycott. The insanity of an elected official calling for economic damage, cutting your nose off to spite your face, is absurd.
5. US Representative Ann Kirkpatrick (Democrat, 1st District): Walked out of her own Town Hall meetings on Health Care Reform because she was being asked questions by her constituency, who largely was (and is) against it. She has remained silent on SB1070.

Where Have You Gone Arizona?
A nation turns it's lonely eyes on you...
I am an Arizonan.
My personal beliefs lean towards civil liberty, personal freedom and libertarian ideals with a tilt of objectivism and conservatism, along with a belief in the rule of law. I tend to listen to different sides of an issue and form my own independent opinion. Sometimes that's contrarian.
Arizona State Senate Bill 1070 the "Arizona Immigration Enforcement Law" has stirred national interest from support to outrage. Calls for boycotting Arizona are growing and conventions and meetings already cancelled. Media coverage is wide and international, from print to radio to televison to social media. One thing I think a lot of the media, political class and out-of-state tsk tsk tskers don't like to admit is that Arizona actually is representative of the vast majority of America. We're the 48th state and just a little more raw and have enough of open range left in us, that we haven't refined ourselves to the false pleasantries like so much of the rest of the country.
My opinions on topics are generally not limited to bullet points, I look at the whole target. I'm a broad thinker and view issues with the wide scope of the social, economic, political, legal and historical aspects around a topic and different elements that have an impact on the subject. That is true with this legislation.
Essentially I believe that the people and State of Arizona have the right to make decisions based on problems presented to it and that illegal immigration and border crossings have been a long standing unresolved problem. The Federal government has been more a part of the problem than the solution and we don't need more of that. We clearly need some type of plan for the illegal immigration and border problem in our state.
This particular Legislature is most likely one of the worst we have ever had and this piece of legislation is actually not the worst thing they've produced and are likely to produce. Our Governor inherited the job and was not fully prepared for it. They all could have done a much better job on major issues presented to them and are still working on.
